Terms of Service

1. About ACE

ACE ("we", "us", "our") is a fitness marketplace platform operated by ACTIVE CONNECT EXPERIENCE LTD., a company registered in Thailand. ACE connects fitness businesses and instructors with users looking to book fitness sessions.

By accessing or using the ACE platform, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Who Can Use ACE

ACE is available to two types of users:

• End users - individuals who browse the platform and book fitness sessions.
• Business users - gym owners, studio operators, and fitness instructors who list their services on ACE.

You must be at least 18 years old to create an account. By creating an account, you confirm that the information you provide is accurate and up to date.

3. Bookings and Payments

When you book a session through ACE, you enter into a direct agreement with the fitness business providing that session. ACE acts as a marketplace and is not a party to the booking itself.

All payments are processed securely by Stripe. ACE does not store your credit card details. By completing a purchase, you also agree to Stripe's terms of service.

All sales are final unless otherwise stated by the business. ACE is not responsible for refunds - please contact the business directly for any refund requests.

4. Business Listings

Business users are solely responsible for the accuracy and legality of the content they publish on ACE, including session descriptions, pricing, and availability. Business users must comply with all applicable Thai laws and regulations.

ACE reserves the right to remove any listing that violates these Terms or is otherwise deemed inappropriate.

5. Prohibited Conduct

You agree not to:

• Provide false or misleading information.
• Use the platform for any fraudulent or unlawful purpose.
• Attempt to gain unauthorised access to any part of the platform.
• Post content that is offensive, defamatory, or harmful.
• Interfere with the proper functioning of the platform.

6. Intellectual Property

All content, design, and code on the ACE platform is owned by ACTIVE CONNECT EXPERIENCE LTD. You may not copy, reproduce, or distribute any part of the platform without our written permission.

7. Limitation of Liability

ACE provides the platform on an "as is" basis. To the maximum extent permitted by Thai law, ACTIVE CONNECT EXPERIENCE LTD. is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including disputes between users and businesses.

8. Termination

We reserve the right to suspend or terminate any account at any time if we believe these Terms have been violated. You may also delete your account at any time by contacting us.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the date at the top of this page. Continued use of ACE after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be subject to the jurisdiction of the Thai courts.
